It’s for Mike Pence to Judge whether a Presidential Election Was Held at All

On January 6, a joint session of Congress will open with Vice President Pence presiding as president of the Senate.  His power will be plenary and unappealable.  You heard that right.  As president of the Senate, every objection comes directly to him, and he can rule any objection “out of order” or “denied.”  His task will be to fulfill his oath of office to protect and defend the Constitution of the United States and to ensure that the laws be faithfully executed.  This is a high standard of performance, and V.P. Pence will have two choices.  He can roll over on “certified” electors, or he can uphold the law.

Article II, Section 1 of the Constitution gives state legislatures “plenary authority” as enunciated in Bush v. Gore.  This is key, since the counting of votes is discussed in Article II, the 12th Amendment, and 3 USC 15.  To this we must add the history of counting and objections recounted by Alexander Macris (here and here).  Put bluntly, it’s as clear as mud.  Add to that the fact that the contested states of Arizona, Georgia, Michigan, New Mexico, Nevada, Pennsylvania, and Wisconsin have sent dueling slates of electors to D.C.  This means that the V.P. has to decide how he will handle the situation when two sealed envelopes are handed to him from any of those states.

Macris points out that in 1800, even with constitutional deficiencies in Georgia, Thomas Jefferson blithely counted defective electoral votes from Georgia, effectively voting himself into the presidency.  This demonstrates that the president of the Senate is the final authority on any motions or objections during the vote-counting.  There is no appeal.  That doesn’t mean there won’t be any outrage.  Whatever Pence does, people will be angry.  But what does the law demand?

Seven contested states clearly violated their own laws. 

An election is a process of counting votes for candidates. Only valid, lawful votes may be counted.  A valid lawful vote is:

  • Cast by an eligible, properly registered elector as prescribed by laws enacted by the state Legislature.
  • Cast in a timely manner, as prescribed by laws enacted by the state Legislature.
  • Cast in a proper form as prescribed by laws enacted by the state Legislature.

Any process that does not follow these rules is not an election.  Anything that proceeds from it cannot be regarded as having any lawful import.

This leaves V.P. Pence with a dilemma.  He is a gentleman who regards our governmental traditions with a degree of reverence, so he will be reluctant to take any bold action.  But as an honorable man, faced with massive illegality, he must act to protect the law.  Consider how things might go down as the two closed envelopes from Georgia are handed to the V.P.  Rather than opening them, he says:

In my hand are envelopes purporting to contain electoral votes from Georgia.  They are competing for consideration, so it is essential that I consider the law that governs this.  That law, according to the Legislature of Georgia and Article II, Section 1 of the U.S. Constitution is the Georgia statute that includes procedures for signature-matching on absentee ballots

  1. The corrupt Uni-Party will have him certify the vote and betray the 100 million and the duly elected POTUS! I do not have much faith in this guy Pence, as he shirks away from making decisions. Those will be made for him, and will he comply. The great betrayal will continue. Trump will have one chance to set the world on a true course after that betrayal. I hope i am wrong in this, but my gut is telling me the opposite. My back up information below. Pence has not done this!

  2. If our hope is in Mike Pence, then we are done as a country. Pence was the Deep State’s insurance policy as VP pick, so that when they impeached Trump and threw him out of office, Pence would be in control. Why are we in this mask and vaccine tyranny? Who picked Fauci and Birx for the Task Force? Who has ties to Big Pharma? Who is going to throw Trump and all patriots under the bus on January 6th? Mike Pence, the heretic.

        Pence isn’t gonna save the day. He’s as much deep-state as Barr is…I’ve been thinking for years now that he’s just waiting to be able to twist the shiv in Trump’s back, but in a way that saves his ‘image’ to run for pres….this is tailor-made for the purpose.

        Yes indeedy, God can use imperfect vessels for His purposes, but He NEVER violates our free will for the purpose….He’s not the moon-rock-false-god allah. And I’ve seen nothing in Pence that ever truly spoke of being on-board the Trump Train. Catherine was patently right on all counts. Put not your trust in princes Mark; Pence is faaaar from a white knight. We’ve got tributation coming (well-earned at that!), hunker down and prepare in earnest. Might wanna re-read the prophesies of Our Lady of Quito (Good Success) again….they come across as the current-day headlines from a really good and accurate news source.

  3. I can’t see anyone but Donald Trump acting on any of this. I can’t see it. God can use the weak, and has, that is for sure, but let’s face it, it’s hard to feel confident about our nation relying on Mike Pence, however good a man he is. I hope I’m not insulting him, I don’t mean to, but thus far he hasn’t bowled us over with his force of personality.
    Whatever means Donald Trump has, whatever Constitutional means, this is where our best chance lies. It does not seem consistent with the man, to allow this election to be stolen. The man seems incapable of tolerating in any way, the virtual destruction of the country he loves.
    We need God to help us, no doubt whatsoever. With God all things are possible. I have always believed it likely it will come down to a desperate situation, where all seems lost, and if the people pray, God will act.
    I’m paraphrasing, but Scripture quotes God as saying “if my people who are called by My name repent of their sins and call to me, I will hear their prayer and heal their lands”.
    We need to pray. Atheists have no reason to hope, but Christians do.

  4. Today, Tuesday December 29th is exactly nine days before the Epiphany. Please everyone: start a novena today for President Trump and for the future of this country. Preferably, a nation liberated from freemasonry and all of its rotten fruits.

    Pence is a deep state scumbag. Put not your trust in princes….and NEVER vote for the Brutuses; there are a daaaaang lot of them.
    Mark, at this point I really REALLY don’t see a reason to vote any more; it’s kabuki theatre and I’m tired of dancing to their fake tune….I’ve never missed a vote (not even for dogcatcher) since I was 18 (59 now), always republican cause I actually believed the line they spewed, but this year….THIS time all the scales fell off. If it’s possible, they’re actually worse than the demonic dems…the dems are straight-up about what they believe and what they’re gonna do; the repubs are deceitful, treasonous, sons of satan…talking out of one side of their mouths and in league the whole time with the left. I really do pray that Trump starts a new party…I will be there in a flash (not that I believe it’ll do any good, but that I’ll have something to vote for other than the uniparty we now have)….and to deny a vote (yeah, right, like they even count votes from the plebes anymore) to the bastard republicans. I’ve NEVER been this angry in my entire life….and I can’t be alone.
